WeekdayDoc is 100% free for healthcare professionals browsing and applying to jobs. You will never be charged to search, view, or apply to any position on our platform.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. Physician Burnout Index™

Data and Methodology

The WeekdayDoc Physician Burnout Index™ ("Burnout Index") is a proprietary data product that aggregates and analyzes physician burnout trends across the United States. The Index is derived from multiple sources including, but not limited to:

  • Peer-reviewed medical research from leading journals
  • Government healthcare workforce data and projections
  • Professional association surveys and reports
  • Real-time online mentions and sentiment analysis
  • User-submitted data and employer-provided information

The Burnout Index is provided for informational purposes only. While we make reasonable efforts to ensure data accuracy by sourcing from reputable institutions and applying rigorous analytical methods, we do not guarantee the completeness, accuracy, timeliness, or reliability of any information presented.

We are not responsible for any decisions made based on Burnout Index data, nor for any consequences resulting from reliance on this information.

Embedding and Usage Rights

We provide embeddable widgets and visualizations from the Burnout Index for use on third-party websites. By embedding our data:

  • Attribution Required: You must maintain the attribution link to WeekdayDoc that is included in the embed code
  • No Modification: You may not alter, remove, or obscure any portion of the embed, including branding or attribution
  • Non-Commercial Use: Embedding is permitted for informational purposes; commercial use requires written permission
  • We May Revoke: We reserve the right to revoke embedding privileges for any reason without notice
  • No Warranty: Embedded data is provided "as is" without warranties regarding accuracy or availability

Citation and Research Use

Researchers, journalists, and organizations may cite the Burnout Index in publications. Proper citation requires:

  • Clear attribution to "WeekdayDoc Physician Burnout Index™"
  • Link to weekdaydoc.com/physician-burnout-index when published online
  • Date of data access noted in citation
  • Acknowledgment that data is subject to revision

Data Updates and Revisions

The Burnout Index is updated periodically as new data becomes available. We reserve the right to:

  • Revise historical data based on improved methodologies or corrections
  • Change data sources or calculation methods without notice
  • Temporarily suspend data collection or publication
  • Discontinue the Burnout Index entirely

4. Work-Life Balance Badges & Scoring

Burnout-Friendly Badges

Job postings on our platform may display "Burnout-Friendly" badges and work-life balance scores. These indicators are based on:

  • Employer-Provided Data: Information submitted by employers regarding job features (no call, no nights, no weekends, remote options, etc.)
  • Auto-Awarded Badges: Automatic badges awarded when jobs meet specific lifestyle criteria
  • Verified Badges: Enhanced badges for jobs with comprehensive work-life balance data

⚠️ Badge Disclaimer

Badges are based on employer-provided information. We do not independently verify all job features or working conditions. The presence of a "Burnout-Friendly" badge does not guarantee:

  • Actual working conditions match the description
  • No overtime or additional responsibilities
  • Specific work-life balance outcomes
  • Protection from physician burnout

Job seekers should verify all job details directly with employers during the interview process.

Scoring Methodology

Work-life balance scores (displayed as X/10) are calculated using a proprietary algorithm that considers multiple factors. Scores are subject to change as we refine our methodology. We make no guarantees regarding the accuracy or stability of scores over time.

Employer Responsibilities

Employers posting jobs with work-life balance features represent and warrant that:

  • All information provided is accurate and truthful
  • Job features (no call, no weekends, etc.) reflect actual working conditions
  • They will update job postings if conditions change
  • They will honor advertised work-life balance commitments

Misrepresentation of job features may result in account suspension and removal of posting privileges.

5. Eligibility

To use our Service, you must:

  • Be at least 18 years old
  • Be legally authorized to work in the jurisdiction where you seek employment
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate, current, and complete information

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

6. User Accounts

Account Creation

To access certain features of our Service, you may be required to create an account. You agree to:

  • Provide accurate, truthful, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities under your account
  • Immediately notify us of any unauthorized use of your account

Profile and Resume

As a job seeker, you may create a profile and upload your resume. You represent and warrant that:

  • All information in your profile and resume is accurate and truthful
  • You have the right to provide all information and content you submit
  • Your profile does not infringe on any third-party rights
  • You will promptly update any outdated information

Job Applications

When applying to jobs through our Service:

  • You understand that we are not the employer and do not control hiring decisions
  • You consent to sharing your application materials with prospective employers
  • You will not submit false or misleading application materials
  • You will not apply to jobs for which you are not qualified or eligible
  • You understand that applying does not guarantee an interview or employment

Communication with Employers

You agree to maintain professional communication with employers and not to harass, spam, or send inappropriate messages through our platform.

8. Terms for Employers

Job Postings

As an employer posting jobs on our Service, you represent and warrant that:

  • You have the authority to post jobs on behalf of your organization
  • All job postings are for legitimate, actual job openings
  • Job descriptions are accurate and not misleading
  • You will comply with all applicable employment and discrimination laws
  • You will not post jobs that are illegal, fraudulent, or deceptive
  • You will not use job postings to collect personal information for non-employment purposes

Candidate Information

When accessing candidate information through our Service, you agree to:

  • Use candidate information solely for employment-related purposes
  • Maintain the confidentiality of candidate information
  • Not share candidate information with unauthorized parties
  • Comply with all applicable data protection laws
  • Not contact candidates for non-employment related purposes

Customer Protection

We maintain a customer protection program. Your job postings will not be scraped or republished without your consent. You acknowledge that becoming a customer automatically enrolls your organization in our protection program.

9. Payment Terms

Fees

Certain features of our Service require payment. Current pricing is available on our pricing page. We reserve the right to modify our fees with 30 days' notice.

Payment Processing

All payments are processed through Stripe. By providing payment information, you:

  • Authorize us to charge your payment method for all fees incurred
  • Represent that you have the legal right to use the payment method
  • Agree to Stripe's terms of service and privacy policy

30-Day Money-Back Guarantee

Performance Guarantee for Job Postings

We guarantee results: If your job posting does not receive at least 3 qualified applicants within 30 days of posting, you are eligible for a full refund of your job posting fee.

To qualify for a refund:

  • Your job posting must have been active for the full 30-day period
  • You must have received fewer than 3 qualified applicants during that period
  • You must request the refund within 7 days after the 30-day period ends
  • The job posting must comply with our content guidelines and terms of service

A "qualified applicant" is defined as a candidate who:

  • Meets the basic requirements stated in your job posting
  • Has submitted a complete application with required credentials
  • Is legally eligible to work in the position's location

To request a refund under this guarantee, contact us at support@weekdaydoc.com with your job posting ID. Refunds will be processed within 5-7 business days.

Other Refund Policies

Subscription and Premium Services

Subscription fees and premium services are non-refundable. Once you purchase a subscription or premium service (excluding standard job postings covered by the 30-day guarantee above), you will not be eligible for a refund.

By making a payment for subscriptions or premium services, you acknowledge and agree that these fees are final and non-refundable, even if you cancel your subscription or are dissatisfied with the results.

10. User Content

Your Content

You retain ownership of content you submit to our Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with providing and improving our Service.

Content Standards

You agree not to post content that:

  • Is false, misleading, or fraudulent
  • Is defamatory, obscene, or offensive
  • Violates any third-party rights
  • Contains viruses or malicious code
  • Violates any applicable laws or regulations
  • Promotes discrimination or harassment
  • Contains personal information of others without consent

Content Removal

We reserve the right to remove any content that violates these Terms or that we find objectionable, without prior notice and at our sole discretion.

11. Prohibited Uses

You agree not to use our Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm another person
  • Impersonate any person or entity
  • Scrape, crawl, or spider any part of the Service without permission
  • Use automated systems or software to extract data
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Use the Service for any illegal or unauthorized purpose
  • Engage in any activity that could damage our reputation
  • Reverse engineer or attempt to extract the source code
  • Remove or alter any proprietary notices
  • Use the Service to send spam or unsolicited communications
  • Create multiple accounts to circumvent restrictions

The Service and its original content (excluding user content), features, and functionality are and will remain the exclusive property of WeekdayDoc and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Feedback

If you provide us with any feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation to you.

13. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF INFORMATION
  • UNINTERRUPTED OR ERROR-FREE SERVICE

We do not guarantee:

  • That you will find employment through our Service
  • That employers will find suitable candidates
  • The accuracy of job postings or candidate profiles
  • The quality, safety, or legality of jobs posted
  • The ability or intent of users to fulfill their obligations
  • That the Service will meet your requirements

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEEKDAYDOC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or similar harmful code transmitted through the Service
  • Any errors or omissions in content
  • Any user content or third-party content posted through the Service

In no event shall our aggregate liability exceed the greater of one hundred dollars ($100) or the amount you paid us in the twelve months preceding the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless WeekdayDoc, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Service
  • Your user content
  • Your violation of any third-party rights
  • Your violation of any applicable laws
  • Any misrepresentation made by you

16. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may do so through your account settings or by contacting us.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

17. Dispute Resolution & Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Informal Dispute Resolution

Before initiating arbitration or any legal action, you agree to first contact us to attempt to resolve any dispute informally. Send a detailed description of your dispute to support@weekdaydoc.com. We will attempt to resolve the dispute within 30 days of receiving your notice.

Binding Arbitration

If we cannot resolve a dispute informally, you and WeekdayDoc agree to resolve any claims through final and binding arbitration, except as set forth below. This includes disputes arising out of or relating to:

  • The interpretation or application of these Terms
  • Your use of the Service
  • The Burnout Index data or work-life balance scores
  • Any transaction or relationship between you and WeekdayDoc
  • Billing or payment disputes

Arbitration Procedures

Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be held in the United States in the county where you live or work, or another mutually agreed location.

  • One Arbitrator: The arbitration will be decided by a single arbitrator
  • Confidentiality: Arbitration proceedings are confidential
  • Discovery: Discovery will be limited to expedite the process
  • Fees: We will pay all AAA filing, administration, and arbitrator fees for claims under $10,000
  • Attorney's Fees: The arbitrator may award attorney's fees to the prevailing party

Exceptions to Arbitration

Either party may seek relief in small claims court for disputes within that court's jurisdiction. Additionally, either party may seek injunctive or other equitable relief in court to prevent infringement or misuse of intellectual property rights.

Class Action Waiver

You and WeekdayDoc agree that any arbitration or proceeding shall be limited to the dispute between us individually.To the full extent permitted by law:

  • No arbitration or proceeding will be joined with another
  • No class arbitration or class action lawsuit is permitted
  • No dispute may be brought on behalf of others as a representative action
  • The arbitrator may not consolidate more than one person's claims

Opt-Out Right

You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms. To opt out, send written notice to: support@weekdaydoc.com with the subject line "Arbitration Opt-Out" and include your name, address, and a clear statement that you wish to opt out of the arbitration agreement.

Severability

If any portion of this arbitration agreement is found to be unenforceable, the remainder shall continue in full force and effect. If the Class Action Waiver is found unenforceable, the entire arbitration agreement (but not the rest of these Terms) shall be void.

18. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If for any reason a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions will remain in full force and effect.

19. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our Service at least 30 days before the changes take effect.

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

Material changes include: Modifications to the arbitration agreement, liability limitations, payment terms, or fundamental Service features. We will provide advance notice of such changes as required by law.
